Applying for indefinite leave to remain, three weeks before I have been in the country for two years?

My visa expires at the beginning of September, spousal visa. I will have held the status for two years but only entered the UK three weeks after the visa was issued. The home office guidelines state that you can apply for indefinite leave to remain after two years from date of visa, unless 'several weeks' ped between entry to the UK and visa issue date? Does anyone have any experience/advice on this, as it seems pretty open to interpretation and don't want to apply for an extension!! Thanks
